1. Introduction

These Terms & Conditions ("Terms") govern your access to and use of our website, mobile applications, platforms, products and services (collectively, the "Services"), including but not limited to the Motor Controller, Valve Controller, Fertigation Unit, Drip Irrigation Automation, Digital Farm Diary, Dashboard, and related hardware and software.

By using our Services, registering with us, or requesting a service (such as installation, maintenance, or a free visit), you agree to these Terms in full. If you do not agree with any part of these Terms, you must not use our Services.

2. Definitions

The following definitions apply in these Terms:

• "User" or "Customer": any person or entity using the Services.
• "Products": hardware devices sold or installed by Khodefarm Automation (e.g., Motor Controller, Valve Controller, Fertigation Unit).
• "Software": mobile apps, web dashboard, firmware and cloud services provided by Khodefarm Automation.
• "Installation": the on-site work done to install Products at the Customer's location.
• "Maintenance": any on-site or remote service provided to repair, update, or service installed Products.

3. Eligibility & Account

• You must be at least 18 years old to enter into these Terms and use our Services.
• When you register for an account or request Services, you must provide accurate, current, and complete information and keep it updated.
• You are responsible for maintaining the confidentiality of your account credentials (username, password) and for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts at our discretion for breach of these Terms, fraudulent activity, or misuse.

4. Scope of Products & Services

Khodefarm Automation provides:

• Sale and installation of hardware Products (Motor Controller, Valve Controller, Fertigation Unit).
• Software for monitoring, scheduling, and automating irrigation and fertigation.
• Maintenance and support services (on-site visits, remote assistance).
• Field surveys, quotations, and advisory services (free visits where applicable).

Note: Actual product specifications, features and available models are described in product pages, quotations, and installation proposals. Features may change over time as we update products and software.

5. Orders, Pricing & Payment

• All product prices, service charges and quotations provided by Khodefarm Automation are indicative and subject to change unless confirmed in a written order acknowledgement.
• Payments must be made according to the terms set in our invoice or quotation. Failure to pay may lead to suspension of services or warranty claims being voided.
• We accept payments via authorised payment gateways, UPI, NEFT/RTGS or as agreed in the contract. We do not store full card details; payment providers' terms apply.
• Taxes, levies and duties are the responsibility of the Customer and will be added to invoices as applicable.

6. Installation & Site Requirements

• Customer must provide accurate site details and ensure safe access for installation and maintenance teams.
• Customer is responsible for any pre-installation site work (e.g., trenching, piping) unless otherwise agreed in writing.
• Installation timelines are estimates. Delays due to weather, site access, supply chain or third-party approvals are not the Company's responsibility.

7. Acceptable Use

When using our Services you must not:

• Use the Services for illegal activities or in breach of any law or regulation.
• Tamper, reverse engineer, modify or attempt to access restricted areas of Products or Software beyond what is permitted.
• Interfere with network operations or attempt to circumvent security mechanisms.

We may suspend or terminate your access for breach of acceptable use.

8. Data, Privacy & Security

Our Privacy Policy (available on our website) governs our collection and use of personal and farm data. By using our Services you consent to that policy. In brief:

• We collect technical, personal, and IoT device data required to deliver automation services.
• Data is stored securely, and we implement industry-standard security measures including encryption, access control and backups.
• We will share data only with authorised service partners as needed for installation and maintenance, payment providers, or when required by law.

9. Warranty & Guarantee

Warranty terms differ by product. The following is a summary — refer to the Warranty Policy for full details:

Drip Irrigation Automation (Controller & Electronics)

• 1 year warranty on electronic components (controller, sensors) against manufacturing defects.
• 6 months warranty on valves and mechanical connectors.
• Warranty void if damage is due to misuse, unauthorized repair, lightning, rodents, or chemical corrosion.

Fertigation Unit

• 1 year warranty on the pump motor and automation panel.
• Tanks: 3-year replacement policy for manufacturing defects (terms apply).
• Sensors: 1 year warranty.
• Chemical corrosion or misuse related damage is not covered.

Requests for warranty service must include proof of purchase and device serial number. Warranty claims are subject to inspection by the Company.

10. Maintenance & Service Charges

Maintenance options include scheduled preventive maintenance, on-demand repairs, and remote diagnostics. Service charges are as per our published schedule (or quotation):

• Farm visit charge, inspection charge, and repairs/parts replacement are chargeable separately.
• Remote troubleshooting is provided free where possible; on-site visits may incur fees.
• Turnaround times depend on part availability and site access.

11. Limitation of Liability & Indemnity

To the fullest extent permitted by applicable law:

• The Company's total liability for any direct loss arising out of or in connection with the Services will not exceed the amount paid by the Customer to the Company for the relevant Services in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, special or consequential losses, including loss of profit, loss of revenue, or loss of business opportunity.
• The Customer agrees to indemnify and hold the Company harmless from any claims, losses, liabilities, damages, fines and expenses arising from misuse, negligence, or breach of these Terms by the Customer.

12. Intellectual Property

• All intellectual property rights in the Services (including software, firmware, documentation, designs and trademarks) remain with Khodefarm Automation or its licensors.
• The Customer is granted a limited, non-transferable license to use the Software in connection with the Products licensed or sold to the Customer.
• The Customer must not copy, modify, distribute, sell or create derivative works without prior written consent.

13. Suspension & Termination

• We may suspend or terminate Services if the Customer breaches these Terms, fails to pay charges, or engages in illegal activity.
• Upon termination, the Customer must cease use of Software and return or dispose of hardware as directed.
• Termination will not affect rights or liabilities accrued prior to termination.

14. Force Majeure

The Company will not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, strikes, supply chain disruptions, governmental actions, pandemics, or severe weather.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes will be resolved by the courts located in Nashik, Maharashtra, India, unless otherwise agreed in writing. Parties will attempt to resolve disputes amicably through negotiation before commencing litigation.

17. Changes to these Terms

We may change these Terms from time to time. The latest version will be posted on our website. Your continued use of Services after changes indicates your acceptance of the updated Terms.
